In Maryland, it can be more difficult to recover because Maryland follows the Law of contributory negligence. Maryland is one of five states that practices this outdated rule. Contributory negligence is when both parties are negligent causing difficulty for the party to recover even if they were only 1% negligent. What this means is if you are found even 1% contributory negligent, you cannot recover. Another thing one must be aware is the statute of limitation. Statute of limitations is a law that provides a time period when a civil case must be filed. In Maryland, you have three years to file from the date of occurrence.

Assumptions of risk is another factor to consider. In the state of Maryland, one is considered to assume risk when he/she enters into a situation with full knowledge and understanding of the dangers that exist, and proceeds anyway.
